Article 1 - Objet

The general conditions of sale described below detail the rights and obligations of the company BILLYTEX and its customers in the context of the sale of goods sold on the site b2b.billybelt.com.

Any purchase made by the customer implies the buyer's unreserved acceptance of these general conditions of sale. These General Conditions may be modified at any time without notice and remain available on the site.

Article 2 - Products presentation

The characteristics of the products offered for sale are presented in the product sheets on the site b2b.billybelt.com. Photographs do not enter into the contractual scope. The BILLYTEX company cannot be held responsible if errors are introduced. All texts and images presented on the site b2b.billybelt.com are reserved, for the entire world, under copyright and intellectual property rights; their reproduction, even partial, is strictly prohibited without express authorization.

Article 3 - Validity period of sales offers

The products are offered for sale while stocks last. In the event of ordering a product that has become unavailable, the customer will be informed of this unavailability, as soon as possible, by email or by telephone.

Article 4 - Products prices

The prices indicated on the site b2b.billybelt.com are in euros excluding tax and excluding shipping costs. The amount of VAT (affected for all deliveries in France only) is specified when validating the delivery location with the addition of shipping costs depending on the delivery method chosen.

The BILLYTEX company reserves the right to modify its prices at any time. The products ordered remain invoiced at the price in effect when the order is placed.

Article 5 - Order

The customer validates his order when he validates the button “I have read the general conditions of sale and I adhere to them without reservation” and activates the “Order with payment obligation” link at the bottom of the “Order” page. Before this validation, the customer can check and modify each of the elements of his order.

The BILLYTEX company confirms the order by email; this information includes in particular all the elements of the order and the customer's right of withdrawal.

The data recorded by the company BILLYTEX constitutes proof of the nature, content and date of the order. This is archived by the company BILLYTEX under the legal conditions and deadlines; the customer can access this archiving on their customer area in the “History” or “GDPR” area or by contacting the Customer Relations department (more info in the article Article 11 | Data Backup and Encryption).

Article 6 - Withdrawal period and returns

The buyer has a period of thirty (30) clear days, from receipt of the products, to exercise his right of withdrawal without having to give reasons or pay penalties, with the exception, where applicable. , return costs. If the fourteen-day period expires on a Saturday, Sunday or public holiday, it is extended until the first following working day.

In the event of exercising the right of withdrawal under the conditions mentioned above, the company BILLYTEX will reimburse the buyer for the totality of the sums paid (excluding shipping costs) by transfer or credit, as soon as possible and at the latest within fourteen days following the date on which the returned product is received by the BILLYTEX company.

All items being returned must be in their original condition, unworn and unwashed, in their original packaging accompanied by their invoice (or copy). BILLYTEX is not required to accept a return for an item that does not comply with these conditions and will not issue a refund.

Article 7 - Exchanges

Any item can be exchanged within the 30-day withdrawal period upon receipt of the order by the customer. During this period, the customer must return the products to be exchanged, attaching the invoice and an explicit request for exchange. The customer can also contact the BILLYTEX company to assert this right to exchange.

If, in exceptional circumstances, an error occurred during the preparation of an order by the BILLYTEX company, the shipping costs for the exchange will be the responsibility of the BILLYTEX company and will be subject to a reimbursement equivalent to the shipping costs incurred by the customer for the return. The shipping costs of the first delivery remain the responsibility of the customer.

Article 8 - Payment methods

All orders will be shipped within 48 hours from the order date (unless expressly indicated by the buyer or the BILLYTEX company). The customer has the option of paying in cash by credit card when ordering or within a maximum period of 30 days from receipt of the order by check, SEPA mandate or bank transfer.

Early or cash payments do not give rise to any discount or rebate.

Payment by SEPA direct debit

The customer must validate the SEPA direct debit with the BILLYTEX company. After validation of your order, the BILLYTEX company will contact the buyer by email in order to set up the SEPA regulation and the direct debit authorization, within 30 days from receipt of the order.

Bank Transfer

Within 30 days of receipt of the order, the customer must make the transfer to the account of the BILLYTEX company following the account information entered on the invoice.

For any payment problem, the customer undertakes to notify BILLYTEX within 15 days of receipt of the order in order to avoid any late payment penalties.

Article 9 - Late payment

Any breach of article 8 - Method of payment will result in the customer being brought into litigation and future orders blocked.

A penalty of 10% of the sums due will be allocated to the invoice including tax, in accordance with the provisions of article 1229 of the Civil Code.

In accordance with articles 441-6 c. com. and D. 441-5 c. com., any late payment automatically entails, in addition to late payment penalties, an obligation for the debtor to pay a fixed compensation of €40 for recovery costs.

Additional compensation may be claimed, with supporting documentation, when the recovery costs incurred exceed the amount of the fixed compensation.

Article 10 - Reservation of title

The BILLYTEX company remains the owner of the merchandise until full payment of its price by the buyer (Law No. 85-98 of January 25, 1985). The mere fact of ordering on the site b2b.billybelt.com constitutes express acceptance of this arbitration clause.

Article 11 - Delivery

Shipping

The BILLYTEX company undertakes to ship any order within 24 to 48 hours from the order date. The customer then has 30 days from receipt of the order to make payment.

The buyer will receive a package tracking email as soon as their order is shipped.

 

Delivery

The transport of goods is entrusted to third party companies depending on the place of delivery (Chronopost, Worldwide, Colissimo, etc.). The BILLYTEX company is not responsible for delivery times, nor for the condition of the package upon delivery and will under no circumstances give rise to compensation or reimbursement of the goods.

Article 12 - Data backup and encryption

The b2b.billybelt.com site is secured via the HTTPS protocol. No data sent to this site passes without being encrypted. The personal information transmitted is stored on a secure server.

The banking data used during payment is transmitted to the secure site of the Crédit Mutuel bank. Data is also encrypted on this site. The BILLYTEX company does not have access to its customers' banking data unless they accept the SEPA mandate.

Collection of personal data

For any information, question or complaint, the customer can contact the Customer Relations department of the company BILLYTEX from Monday to Friday, from 8 a.m. to 12 p.m. and from 2 p.m. to 5 p.m.
